Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a binding legal agreement between you and Admaginations LLC, doing business as Recommended.app ("we," "us," "our"). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the Service. We reserve the right to modify these Terms at any time. Changes will be effective when posted, and your continued use of the Service constitutes acceptance of the updated Terms.

2. Description of Service

Recommended.app is a people-powered local discovery and recommendation platform. The Service includes city hub pages with curated local recommendations, affiliate booking links to third-party providers, personalized referrer landing pages, a referral commission program, and related tools. We act as an intermediary connecting users with third-party products and services — we do not directly provide the tours, hotels, events, home services, or other products listed on the platform.

3. Eligibility

You must be at least 18 years old to create an account on the Service. If you are using the Service on behalf of a business or other entity, you represent and warrant that you have the authority to bind that entity to these Terms.

4. User Accounts

Registration

To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update your information as necessary to keep it accurate and complete.

Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

Account Termination

You may delete your account at any time through your dashboard settings. We reserve the right to suspend or terminate your account if you violate these Terms or engage in conduct that we determine, in our sole discretion, to be harmful to the Service or other users.

5. Referral Program

Referrer Eligibility

Registered users may earn commissions by sharing their unique referral links and driving qualifying transactions through the Service. Participation in the referral program is subject to these Terms and any additional program guidelines.

Commission Structure

Commission rates vary by affiliate partner and product category. The platform retains a share of affiliate commissions earned through referral activity. Commission rates are subject to change at any time, and current rates are displayed in your dashboard.

Payouts

Commissions are paid when your balance reaches the minimum payout threshold. Payouts are processed according to the schedule displayed in your dashboard. We reserve the right to withhold or reverse commissions in cases of fraud, returns, cancellations, or policy violations.

Tax Obligations

Referrers are solely responsible for reporting and paying all applicable taxes on commissions earned. We may require a completed W-9 form before processing payouts and will issue 1099 forms as required by applicable tax law.

Prohibited Referral Practices

The following practices are strictly prohibited and may result in forfeiture of all earned commissions and termination of your account: sending spam or unsolicited messages containing referral links; bidding on our brand terms ("Recommended.app," "Recommended") in paid search advertising; creating misleading content or making false claims about products or services; generating fraudulent clicks or transactions; and violating the terms of any affiliate partner program. Violation of these rules will result in immediate forfeiture of unpaid commissions and may result in account termination.

6. Subscription Plans

The Service may offer subscription plans with varying tiers, features, and pricing as described on our pricing page. Subscriptions auto-renew unless cancelled before the renewal date. You may cancel your subscription at any time through your dashboard. Cancellation takes effect at the end of the current billing period.

7. Third-Party Services and Affiliate Links

Third-Party Transactions

When you click an affiliate link and complete a transaction on a third-party website, that transaction is between you and the third-party provider. We are not a party to that transaction and bear no responsibility for the products, services, or customer support provided by third parties.

Third-Party Terms

Third-party providers have their own terms of service and privacy policies. By completing a transaction through an affiliate link, you agree to be bound by the applicable third party's terms.

No Endorsement

The inclusion of any product, service, or provider on the Service does not constitute an endorsement or guarantee of quality, safety, or suitability. Listings are provided for informational purposes, and you should conduct your own due diligence before making any purchase.

8. Affiliate Relationships & Commission Structure

Affiliate Partnerships

Recommended.app participates in affiliate programs with third-party partners including, but not limited to, Viator, Amazon Associates, Hotels.com, Expedia, Angi, Stay22, Travelpayouts, Klook, TicketNetwork, and 12Go. When you click an affiliate link on the Service and complete a qualifying transaction, Recommended.app earns a commission from the partner. This commission does not increase the price you pay.

Commission Rates

Commission rates vary by partner and product category. Rates are set by the affiliate partners and are subject to change without notice. The specific commission earned on any given transaction depends on the partner's program terms, the product category, and the transaction amount.

Referrer Commission Split

Registered referrers who drive qualifying transactions through their referral links receive a 50% share of the affiliate commission earned by Recommended.app on that transaction. The remaining 50% is retained by Recommended.app to fund platform operations, development, and maintenance. This split applies to all affiliate partner programs unless otherwise specified in your dashboard.

9. User Content

Your Content

You retain ownership of any content you create, upload, or submit to the Service ("User Content"). By submitting User Content, you grant Admaginations LLC a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, modify, display, and distribute your User Content in connection with operating and promoting the Service.

Content Standards

You agree not to submit content that is illegal, false or misleading, hateful or discriminatory, spam or unsolicited advertising, contains malware or malicious code, or infringes on the intellectual property rights of others. We reserve the right to remove any User Content that violates these standards or that we determine, in our sole discretion, to be harmful to the Service or its users.

10. Intellectual Property

Our Property

The Service, including its design, code, graphics, logos, page layouts, and overall look and feel, is owned by Admaginations LLC and is protected by United States and international copyright, trademark, and other intellectual property laws.

Trademarks

"Recommended.app" and "Recommended" are trademarks of Admaginations LLC. You may not use our trademarks without our prior written consent.

11. Prohibited Conduct

You agree not to use the Service for any unlawful purpose; attempt to gain unauthorized access to any part of the Service, other accounts, or computer systems; use bots, scrapers, or automated tools to access the Service without our written permission; interfere with or disrupt the Service or its infrastructure; manipulate metrics including clicks, referrals, views, or commissions; impersonate any person or entity; transmit malware, viruses, or other harmful code; or use the Service to build a competing product without our prior written consent.

12. Disclaimers

"As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

No Guarantee

We do not warrant that the Service will be uninterrupted, error-free, secure, or free from viruses or other harmful components. We make no guarantees regarding the accuracy or completeness of any content on the Service.

Referral Income

Participation in the referral program does not guarantee any level of earnings. Commission amounts depend on factors outside our control, including user behavior, partner conversion rates, and partner program changes.

13. Limitation of Liability

To the maximum extent permitted by applicable law, Admaginations LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Our total aggregate liability for all claims arising out of or related to the Service shall not exceed the greater of (a) the amounts you paid to us in the twelve (12) months preceding the claim or (b) one hundred dollars ($100).

14. Indemnification

You agree to indemnify, defend, and hold harmless Admaginations LLC, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your User Content, or your violation of these Terms.

15. Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Nevada, without regard to its conflict of laws principles.

Arbitration

Any dispute arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) in Clark County, Nevada. Arbitration shall be conducted on an individual basis only — you agree to waive any right to participate in a class action, class arbitration, or representative proceeding.

Exceptions

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.

16. Termination

We may terminate or suspend your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service will immediately cease. The following sections shall survive termination: User Content (Section 9), Intellectual Property (Section 10), Disclaimers (Section 12), Limitation of Liability (Section 13), Indemnification (Section 14), and Dispute Resolution (Section 15).

17. General Provisions

Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Admaginations LLC regarding the Service and supersede all prior agreements and understandings.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.

Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms due to causes beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, war, terrorism, government actions, or failures of third-party services.
