Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a binding legal agreement between you and Admaginations LLC, doing business as Recommended.app ("we," "us," "our"). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the Service. We reserve the right to modify these Terms at any time. Changes will be effective when posted, and your continued use of the Service constitutes acceptance of the updated Terms.

2. Description of Service

Recommended.app is a people-powered local discovery and recommendation platform. The Service includes city hub pages with curated local recommendations, affiliate booking links to third-party providers, personalized referrer landing pages, a referral commission program, and related tools. We act as an intermediary connecting users with third-party products and services — we do not directly provide the tours, hotels, events, home services, or other products listed on the platform.

3. Eligibility

You must be at least 18 years old to create an account on the Service. If you are using the Service on behalf of a business or other entity, you represent and warrant that you have the authority to bind that entity to these Terms.

4. User Accounts

Registration

To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update your information as necessary to keep it accurate and complete.

Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

Account Termination

You may delete your account at any time through your dashboard settings. We reserve the right to suspend or terminate your account if you violate these Terms or engage in conduct that we determine, in our sole discretion, to be harmful to the Service or other users.

5. Referral Program

Referrer Eligibility

Registered users may earn commissions by sharing their unique referral links and driving qualifying transactions through the Service. Participation in the referral program is subject to these Terms and any additional program guidelines.

Commission Structure

Commission rates vary by affiliate partner and product category. The platform retains a share of affiliate commissions earned through referral activity. Commission rates are subject to change at any time, and current rates are displayed in your dashboard.

Payouts

Commissions are paid when your balance reaches the minimum payout threshold. Payouts are processed according to the schedule displayed in your dashboard. We reserve the right to withhold or reverse commissions in cases of fraud, returns, cancellations, or policy violations.

Tax Obligations

Referrers are solely responsible for reporting and paying all applicable taxes on commissions earned. We may require a completed W-9 form before processing payouts and will issue 1099 forms as required by applicable tax law.

Prohibited Referral Practices

The following practices are strictly prohibited and may result in forfeiture of all earned commissions and termination of your account: sending spam or unsolicited messages containing referral links; bidding on our brand terms ("Recommended.app," "Recommended") in paid search advertising; creating misleading content or making false claims about products or services; generating fraudulent clicks or transactions; and violating the terms of any affiliate partner program. Violation of these rules will result in immediate forfeiture of unpaid commissions and may result in account termination.

6. Subscription Plans

The Service may offer subscription plans with varying tiers, features, and pricing as described on our pricing page. Subscriptions auto-renew unless cancelled before the renewal date. You may cancel your subscription at any time through your dashboard. Cancellation takes effect at the end of the current billing period.

7. Third-Party Services and Affiliate Links

The Service includes links to third-party websites and services, including but not limited to: Viator, Hotels.com, Expedia, Angi, Clipp, AliExpress, 12go, Travelpayouts (Klook, TicketNetwork, Kiwi, GetTransfer, GetRentacar, Tiqets, LocalRent), Stay22, Amazon, and Temu. These third-party services operate under their own terms of service and privacy policies. We are not responsible for the availability, content, accuracy, fulfillment, pricing, or service quality of any third-party service.

When you click a third-party link, you leave Recommended.app and become subject to that third party's terms.

8. Affiliate Relationships and Commission Structure

Recommended.app participates in affiliate marketing programs with the partners listed in §7. When you click an affiliate link and complete a qualifying booking, purchase, or sign-up, Recommended.app may earn a commission at no additional cost to you.

Per FTC 16 CFR Part 255 (Guides Concerning the Use of Endorsements and Testimonials in Advertising):

• Recommended.app discloses material connections with all affiliate partners.
• The presence of an affiliate relationship does not influence editorial rankings or which businesses appear in search results.
• Featured placements (paid placements that influence ranking or visibility) are clearly labeled "Featured" or "Sponsored" wherever they appear.
• User-submitted reviews are not influenced by affiliate relationships.
• We do not accept payment to suppress, hide, or alter user reviews.

9. User Content

Your Content

You retain ownership of any content you create, upload, or submit to the Service ("User Content"). By submitting User Content, you grant Admaginations LLC a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, modify, display, and distribute your User Content in connection with operating and promoting the Service.

Content Standards

You agree not to submit content that is illegal, false or misleading, hateful or discriminatory, spam or unsolicited advertising, contains malware or malicious code, or infringes on the intellectual property rights of others. We reserve the right to remove any User Content that violates these standards or that we determine, in our sole discretion, to be harmful to the Service or its users.

10. Intellectual Property

Our Property

The Service, including its design, code, graphics, logos, page layouts, and overall look and feel, is owned by Admaginations LLC and is protected by United States and international copyright, trademark, and other intellectual property laws.

Trademarks

"Recommended.app" and "Recommended" are trademarks of Admaginations LLC. You may not use our trademarks without our prior written consent.

11. Prohibited Conduct

You agree not to use the Service for any unlawful purpose; attempt to gain unauthorized access to any part of the Service, other accounts, or computer systems; use bots, scrapers, or automated tools to access the Service without our written permission; interfere with or disrupt the Service or its infrastructure; manipulate metrics including clicks, referrals, views, or commissions; impersonate any person or entity; transmit malware, viruses, or other harmful code; or use the Service to build a competing product without our prior written consent.

12. Disclaimers

"As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

No Guarantee

We do not warrant that the Service will be uninterrupted, error-free, secure, or free from viruses or other harmful components. We make no guarantees regarding the accuracy or completeness of any content on the Service.

Referral Income

Participation in the referral program does not guarantee any level of earnings. Commission amounts depend on factors outside our control, including user behavior, partner conversion rates, and partner program changes.

13. Limitation of Liability

To the maximum extent permitted by applicable law, Admaginations LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Our total aggregate liability for all claims arising out of or related to the Service shall not exceed the greater of (a) the amounts you paid to us in the twelve (12) months preceding the claim or (b) one hundred dollars ($100).

AI-Generated Output

Recommended.app's AI Assistants (including Custom GPTs on ChatGPT and similar platforms) may produce recommendations, summaries, descriptions, or other output that is incorrect, outdated, or fabricated. You acknowledge and agree that:

(a) AI-generated recommendations may contain errors, omissions, or hallucinated details that do not reflect actual business operations.

(b) Pricing, hours, availability, and contact information returned by AI Assistants may be outdated by minutes, hours, or days, and you should independently verify any information that is material to your decision (booking dates, prices, contact information, hours of operation) before acting on it.

(c) Booking links surfaced by AI Assistants direct to third-party platforms operating under their own terms; we are not liable for the third party's availability, fulfillment, or service quality.

(d) Reviews returned by AI Assistants are written by individual users and reflect personal experience; we do not verify that reviewers actually used the business reviewed.

To the maximum extent permitted by law, Recommended.app is not liable for direct, indirect, incidental, consequential, or special damages arising from reliance on AI-generated output, including but not limited to lost bookings, missed reservations, incorrect pricing, scheduling conflicts, or dissatisfaction with a recommended business or experience.

14. Use of AI Assistants

Recommended.app operates Custom GPTs and AI assistants on third-party platforms including ChatGPT (OpenAI). When you use a Recommended.app AI Assistant:

1. You are also subject to the underlying AI platform's terms of service (e.g., OpenAI's Usage Policies). Those terms govern your use of the AI platform itself.
2. The recommendations, business listings, ratings, prices, and other information returned by our AI Assistants are aggregated from publicly available sources, user-submitted reviews, and our affiliate partners. We make no warranty that this information is current, accurate, or complete at the time you receive it.
3. Our AI Assistants are informational tools. They do not constitute professional advice (medical, legal, financial, travel safety, or otherwise) and they do not represent endorsement of any specific business, service, or activity.
4. AI Assistants may make errors, hallucinate, return outdated information, or misinterpret your request. Always verify critical information before booking, purchasing, or relying on a recommendation.
5. You may not use our AI Assistants to: scrape data at scale, reverse-engineer our API, generate spam or impersonation content, harass other users or businesses, or violate any applicable law.
6. We may modify, restrict, or discontinue any AI Assistant at any time without notice.

15. Public API Usage

Recommended.app's public API at https://www.recommended.app/api/v1/* is provided for the use of:

• Recommended.app's own AI Assistants and partner widgets
• Approved third-party integrations under written agreement
• Limited evaluation and exploratory testing

You may not:

1. Scrape the API for resale or redistribution of the data
2. Build a competing directory product using the API as your primary data source
3. Misrepresent yourself as Recommended.app or its data partners
4. Cache or store API responses for longer than 24 hours without written permission
5. Exceed reasonable rate limits (currently 60 requests per minute per IP, subject to change)
6. Attempt to access endpoints not documented at /api/v1/

We reserve the right to revoke API access at any time for violations of these terms or any unreasonable burden on our infrastructure. For commercial API access, contact admin@recommended.app.

16. Indemnification

You agree to indemnify, defend, and hold harmless Admaginations LLC, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your User Content, or your violation of these Terms.

17. Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Nevada, without regard to its conflict of laws principles.

Arbitration

Any dispute arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) in Clark County, Nevada. Arbitration shall be conducted on an individual basis only — you agree to waive any right to participate in a class action, class arbitration, or representative proceeding.

Exceptions

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.

18. Termination

We may terminate or suspend your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service will immediately cease. The following sections shall survive termination: User Content (Section 9), Intellectual Property (Section 10), Disclaimers (Section 12), Limitation of Liability (Section 13), Indemnification (Section 16), and Dispute Resolution (Section 17).

19. General Provisions

Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Admaginations LLC regarding the Service and supersede all prior agreements and understandings.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.

Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms due to causes beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, war, terrorism, government actions, or failures of third-party services.
